Please read the terms and conditions ("Terms and Conditions") set out below carefully before obtaining Services from this Website. By acquiring Free Appraisal and/or sending the Item(s) for Valuation and/or accepting fund transfer, you agree to be bound by the following Terms and Conditions:

  1. Introduction

    We are Speedpawn, a brand under www.speedpawn.my, unless otherwise stated.

  2. Definitions / Interpretations

    1. "Agreement" is a reference to the Terms and Conditions, Privacy Policy and/or any other forms and payments instructions provided to you.
    2. "Website" refers to www.speedpawn.my.
    3. "Privacy Policy" is the policy displayed in the Website detailing how your personal data is collected and stored.
    4. "You" refers to the person accessing the Website and acquiring services from Speedpawn and/or any other channels provided by Speedpawn.
    5. "We" refers Speedpawn. "Service(s)" refers to any services rendered as per request(s) vide the Website.
    6. "Item(s)" refers to any object(s) and/or instrument(s) as listed in the Website that is presented to Speedpawn to be appraised and/or valued and/or pawned.
    7. "Appraisal" refers to a process which the Item(s) is valued.
    8. "Pawn" refers to us providing you loan with valuable as collateral.
    9. "Sum" refers to the total amount consisting of the principal pawn value and payable interest.
    10. "Loan Term(s)" refers to the period of twelve (12) months from the time the Item is pawned.
    11. "Redeem" and/or "Redemption" refer to the process where you will be collecting the Items upon the payment of the Sum due and payable.

  3. Pawning

    1. You agree to provide us with your details and confirm that these details are accurate and complete at the time of pawning.
    2. We will take all reasonable care, in so far as it is in our power to do so to keep the Appraisal and Pawning item(s) secure.
    3. Any request(s) for Appraisal is subject to our availability, capacity, and acceptance by us. When you place your Appraisal request online, we will send you an email relating to the Valuation of the Item(s).
    4. If you wish to proceed with the pawning, we will make arrangements for the Item(s) so to be collected from the address provided in the Pickup Form.
    5. Upon receiving the Item(s) sent, Assessment and Verification will be carried out to identify the current value of the Item(s). You are deemed to have consented to the Assessment and Verification process.

  4. Acknowledgement

    1. You are required to fill in the appraisal forms provided in the Website upon requesting for the Item(s) to be appraised prior to pawning.
    2. You are deemed to have consented to the Terms of Use and Privacy Policy upon submission of the appraisal request.
    3. You are deemed to have consented to sending the Item(s) to us at the completion of the pickup form.
    4. You are deemed to have agreed to the appraisal value of the Item(s) the moment you arranged the Item(s) to be collected and delivered to the centre.

  5. Cancellation

    1. In the event that you do not wish to proceed with pawning process, you shall notify us vide the Website.
    2. We reserve all rights to discontinue the appraisal process upon discovering discrepancies in actual condition of the Item(s) as compared to the descriptions and/or details of the Item(s) as provided by you.
    3. In the event of the occurrence of Section 5.2, the Item(s) will be returned by us to you.

  6. Limitation of Liability

    1. Great care has been taken to ensure that the information available on this Website is correct and error free. We apologize for any errors or omissions that may have occurred. We cannot warrant that use of the Website will be error free or fit for purpose, timely, that defects will be corrected, or that site or server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website and we do not make any warranty whatsoever, whether express or implied, relating to fitness for purpose, or accuracy.
    2. By accepting these terms of use, you agree to absolve us from any liability whatsoever arising from your use of information from any third party, or your use of any third party website.
    3. We will not be held liable for any delays, failures, errors or omissions or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your computer system vide our Website.
    4. We have taken all reasonable steps to prevent Internet fraud and ensure that all data collected from you is stored as securely and safely as possible. However, we cannot be held liable in extremely unlikely event of breach in our secure computer servers or those of third parties.
    5. We shall not be held liable for any losses suffered in the process of payment(s) by us upon confirmation of details provided by you are accurate. Payment(s) will be made in accordance to the details provided by you and shall be deemed accurate.
    6. We shall not be held liable for any losses suffered in the process of Redemption upon confirmation of details provided by you are accurate. Item(s) shall be redeemed in accordance to the details provided by you and shall be deemed accurate.

  7. General

    1. We may alter or vary the Terms of Use at any time without notice to you.
    2. Do not use or launch any automated system or program in connection with the Website.
    3. Do not collect or harvest any personally identifiable information from the Website, use communication systems provided by the Website for any commercial solicitation purposes, solicit for any reason whatsoever any users of the Website with respect to their submissions to the Website, or publish or distribute any codes in connections with the Website, or hack the Website.
    4. The Terms of Use together with the Privacy Policy, any forms and payment instructions constitute the entire agreement between you and us. No other terms whether expressed or implied shall form part of this Agreement. In the event of any conflict between these Terms Of Use and any other terms or provisions on the Website, these Terms of Use shall prevail.
    5. If any term or condition of the Agreement shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the Agreement shall continue in force without such term or condition.
    6. These Terms of Use and the Agreement shall be governed by and construed in accordance with the laws of Malaysia. The parties hereto submit to the exclusive jurisdiction of the courts of Malaysia.
    7. No delay or failure on our part to enforce our rights or remedies under the Agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.
    8. These Terms of Use and a contract (and all non contractual obligations arising out of or connected to them) shall be governed and construed in accordance with Malaysian Laws. The parties hereby submit to the non exclusive jurisdiction of the Malaysian Courts. All terms, dealings, correspondences and contacts between us shall be made or conducted in English language.
